Welcome to Next2URoofing. These Terms of Service (“Terms”) govern your use of our services, including but not limited to roof inspections, repairs, replacements, and related marketing communications.
Your Acceptance of These Terms
By accessing and using our website, contacting us via any method (including phone, email, or web form), or subscribing to any of our services or marketing efforts, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our website, contact our business, or subscribe to our communications.
For any specific services that require a proposal agreement, your acceptance of that separate agreement can be provided via an ink signature, digital signature, or by expressing your acceptance through written communication such as SMS or email.
1. Services and proposals
- Service Offerings: We offer various roofing and related services. Specific details, scope of work, and pricing for any job are outlined in a separate, written proposal agreement.
- Contingency for Unforeseen Conditions: Our proposals are based on visible conditions. You agree to pay for any additional work and costs resulting from unforeseen conditions discovered during a project at our standard rates, upon written agreement.
- Material Substitutions: We reserve the right to substitute materials with those of equal or superior quality if the specified materials become unavailable.
2. Payments
- Payment Terms: The payment schedule and terms, including any deposit, progress payments, and final payment, will be specified in your service contract.
- Deductibles: You are solely responsible for paying your insurance deductible. We will not waive, rebate, or absorb any part of your insurance deductible, in compliance with Texas law.
- Late Payments: Failure to make payments on time may result in project delays, suspension of work, or collection efforts.
3. Online payment services
We may use third-party payment processors, such as Stripe, to facilitate online payments. By using payment links or any other online payment method we offer, you agree to the terms and conditions of the third-party payment processor.
- Authorization: By submitting a payment through an online link, you authorize the charge to be processed for the agreed-upon amount.
- No warranty: We are not responsible for any security, technical, or other issues related to the third-party payment processor.
- Liability: Next2URoofing is not liable for any issues, damages, or disputes that arise from your use of the third-party payment service.
4. Data collection and usage
We collect personal information and job-related data for marketing, record-keeping, and business operations. By providing your information during an inspection or other contact, you consent to its use for future marketing efforts. Our collection and use of this information are further described in our Privacy Statement.
- Website Data: We gather basic website interaction information to improve user experience and analyze site performance.
- Marketing Communications: We use your information to send newsletters, marketing emails, or call reminders and for future marketing efforts. This includes contacting any phone number or email address that you provide to us as a referral.
- Record-Keeping: We retain job and resident information, including addresses, job amounts, photos, and project notes, for our business records and to resolve any disputes.
- Data Retention: We retain client personal information (name, phone number, email) even if a proposal agreement isn’t accepted for future marketing efforts and records, subject to your right to request deletion. This data is not sold.
5. SMS communication
By providing your mobile phone number, you consent to receive text messages from us regarding your inquiries, services, and related information.
- No Marketing Data Shared: We will not sell, rent, or lease your phone number or SMS opt-in data for third-party marketing purposes.
- Message Frequency: Message frequency will vary based on your interactions with us, your project status, and your communication preferences.
- Opt-Out: You can revoke your consent at any time. To stop receiving text messages, reply “STOP” to any text message from us.
- Rates: Standard message and data rates may apply according to your mobile carrier.
- Consent Not Required for Service: Opting into SMS messaging is not a condition of purchasing our goods or services.
6. Job photos as proof of work
For most jobs, we capture photos to document the project’s progress, condition, and completion. You agree that we own the copyright to these photos and may use them for internal record-keeping, to demonstrate completion of work, or for dispute resolution. You acknowledge that these photos do not contain personally identifiable information about you or your household and are taken on your property with your consent.
7. Post-completion communication
After a job is completed, we may contact you via email, SMS, or phone to gather feedback on your service experience and satisfaction. This communication is for internal quality control purposes, to improve our services, and may be used for marketing purposes with your consent.
8. Insurance and licensing
Upon request, we will provide you with information regarding our business and liability insurance coverage. While general liability insurance is not legally mandated for all contractors in Texas, we carry coverage to protect our business and provide peace of mind to our customers.
9. Inspections and access
During any inspection or accepted job, you agree to inform us of all known or suspected leaks or water-related issues, both on and near the scope of work. You will provide reasonable access to our personnel to inspect the interior of the property for water spots or other signs of leaks. Failure to disclose known issues near the scope of work may void any warranty provided.
10. Website and newsletter
- Acceptable Use: By using our website or subscribing to our newsletter, you agree to use them for their intended purposes. Unauthorized use, such as data scraping or spam, is prohibited.
- Changes to Terms: We may update these Terms of Service at any time. Your continued use of our services or subscription to our newsletter after such changes constitutes your acceptance of the new Terms.
11. Modifications and adjustments to proposal agreement
You may not modify a proposal agreement in any way without the express written consent of Next2URoofing. Any modification proposed by you that is accepted by Next2URoofing will be subject to modification charges or changes in the price, specifications, or time of performance of the work, as determined in Next2URoofing’s sole discretion, which changes are binding on you. After a proposed modification is approved by an authorized Next2URoofing representative, we will provide an updated proposal agreement with the changes for your review and acceptance. In its sole discretion, Next2URoofing may suspend work during the pendency of any contemplated modifications or adjustments. Prices are subject to change due to significant material price changes.
12. Temporary roof cover-ups and access
For any temporary cover-up services, you agree that we are not responsible for any leaks caused by the temporary cover, as it is a preventative measure and subject to external factors like wind and weather. While we ensure the temporary cover is secured, its integrity can be compromised by severe weather conditions beyond our control. The temporary cover may be removed during job completion if the proposal is accepted, once the proposal is denied (even if it hadn’t expired), or on or after the proposal expiration date depending on the situation. You grant us permission to access the property to retrieve any equipment, tools, or materials, even if the proposal was not accepted. If access is denied, we reserve the right to place a mechanic’s lien against your property as permitted by law. In the event we are unable to retrieve our materials, we are not responsible for any damage they may cause to your property or any neighboring property.
13. Warranties and claims
Warranty details for any job will be outlined specifically within the proposal agreement. Next2URoofing’s warranty begins once all proposed work is completed and paid in full. Warranty claims must be made before the warranty expiration date specified in your proposal agreement. Any warranty provided is contingent upon you informing us of all known or suspected leaks near the area of the scope of work. Failure to provide this information may void the warranty, and we will assume no liability for the undisclosed issues.
If Next2URoofing determines in its sole discretion that all or part of its work is defective, you agree that Next2URoofing will have the right to remedy the error, defect, or omission in any reasonable manner. You agree to allow reasonable access to Next2URoofing to accomplish any necessary remedy. Failure to grant such reasonable access to the property or house will constitute a waiver by you of your claim.
14. Collections efforts
In the event of non-payment for services rendered, you agree that we may use all legal means necessary to collect the outstanding debt. This may include, but is not limited to, referring the account to a third-party collections agency, reporting the debt to a credit bureau, and, as permitted by Texas law, filing a mechanic’s lien against your property. You acknowledge that a mechanic’s lien can prevent you from selling or refinancing your property until the debt is resolved.
15. Communications in dispute resolution
You agree that any and all communications, including but not limited to email, text messages (SMS), phone calls, or written correspondence between you and Next2URoofing, will be used to resolve any disputes. These communications may be presented as evidence to support our position in any legal or alternative dispute resolution proceeding.
16. Disclaimers and limitation of liability
- No Guarantee of Outcome: We do not guarantee the outcome of any insurance claim.
- “As Is” Basis: All information and services on our website and in our newsletters are provided “as is” without warranty of any kind.
- Limitation of Liability: Our liability is limited to the terms of your signed proposal agreement. We are not liable for any indirect, incidental, or consequential damages.
17. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms will be resolved in the appropriate courts of Texas.
